APPLICATION FOR AUTHORIZATION TO BRING A CLASS ACTION AND TO BE NAMED CLASS REPRESENTATIVE
(Articles 571 and ss C.p.c.)<\/p>

Group members are individuals or companies who received a notice and a default notice from one of the Caisses populaires Desjardins du Qu\u00e9bec due to delayed mortgage payments.<\/p>

The fault of the Caisses and the defendant Groupe services partag\u00e9s Desjardins inc.:<\/b><\/u><\/p>

  1. The borrower was late in paying their mortgage.<\/li>
  2. Following this delay, all Caisses Populaires in Quebec instructed the defendant, Groupe Services Partag\u00e9s Desjardins, to send a default notice called a \u201cPrior notice\u201d.<\/li>
  3. In this notice, the defendant demanded payment of the overdue monthly payments.<\/li>
  4. Additionally, the defendant demanded payment of its attorneys’ fees and expenses.<\/li>
  5. However, these fees and expenses claimed are illegal and prohibited by law.<\/li>
  6. These fees can range from a few hundred dollars to a few thousand dollars.<\/li>
  7. Despite the clarity of the law prohibiting these fees in the Civil Code of Quebec, the defendant continues to charge them to customers on behalf of the Caisses Populaires.<\/li><\/ol>

    The claim<\/u><\/b><\/p>

    1. Reimburse the illegally charged fees (this amount varies from consumer to consumer).<\/li>
    2. Order the defendant to pay $500 to each member for moral damages.<\/li><\/ol>
